Doknjas Chess Fair Play Agreement

Article 1 – Purpose

1.1.      The purpose of this agreement is to uphold and ensure integrity and fair competition during Doknjas Chess events and tournaments. Players participating in an event or tournament expect a basic level of good-natured sportsmanship and honesty at all times from their fellow players. It is to this end that all players must agree to a common set of responsibilities and guidelines if they wish to participate in any Doknjas Chess events or tournaments.

Article 2 – Player Behaviour

2.1.      Players at all times shall exhibit a basic level of sportsmanlike conduct and respect to their fellow players and tournament staff. Behaviour that will not be tolerated may include, but is not limited to, harassment, bullying, belittling other players, and/or unsportsmanlike conduct.

2.2.      Conduct at tournaments or events is regulated by Doknjas Chess, and Doknjas Chess has the authority to deem any form of conduct that they believe to be intolerable, inappropriate or unsportsmanlike as such, and has the authority to apply whatever penalty they feel is appropriate to the offending player, and may apply any reasonable remedy to rectify the situation.

2.3.      Players agree to adhere to the rules and regulations of the event or tournament they are attending or participating in.

Article 3 – Cheating

3.1.      No form of cheating will be tolerated at any time. Forms of cheating include, but are not limited to, playing with assistance from another person, computer, or referential material.

3.2.      Doknjas Chess has complete discretion in determining if a player is, or has been, cheating during an event or tournament OR ANY TIME AFTER THE EVENT OR TOURNAMENT HAS ENDED. No proof or evidence is required for Doknjas Chess to make a finding of cheating. Doknjas Chess also has complete discretion to apply whatever reasonable penalty they feel is appropriate to the offending player.

3.3.      Some possible penalties a cheating player may face include:

  • If the cheating is discovered to be during the tournament or event, the offending player’s previous, current, and future games in the tournament or event will be forfeit.
  • If the cheating is discovered after the tournament, the offending player’s posted results on the CFC website will display an X and a 0 for the game score for each game the player was found cheating.
  • The offending player may also face banishment from all future Doknjas Chess tournaments or events.
  • If the offending player is a Doknjas Chess student, the student may face immediate removal from the program and a refund for the remaining classes may be issued at the discretion of Doknjas Chess.

Article 4 – Limitation of Liability

4.1.      Doknjas Chess and any staff employed by Doknjas Chess shall not be liable for any error of judgment or mistake or for any loss or damage (including damage to reputation) suffered by a player in connection with the performance of this Agreement, except a loss resulting from willful misfeasance, bad faith or gross negligence on the part of Doknjas Chess or any staff employed by Doknjas Chess in the performance of their duties or from reckless disregard for their obligations and duties under this Agreement.

Article 5 – Current Doknjas Chess Students

5.1.      Article 5 only applies to students currently registered with Doknjas Chess.

5.2.      By agreeing to the ‘DOKNJAS CHESS FAIR PLAY AGREEMENT’ the student also agrees that the ‘ACKNOWLEDGMENT, WAIVER, AND CONSENT’ agreement previously agreed to will be amended to include the entirety of that original agreement in addition to the entirety of Article 3 of this agreement.

Article 6 – Entire Agreement

6.1.      This agreement shall constitute the entire agreement between the parties. There is no representation, warranty, collateral agreement or condition which effects this agreement other than as expressed therein except for any representations or warranties made in writing by Doknjas Chess to a specific participant.
